This
Agreement will govern the relationship between you
and A Step Above Service Evaluations.
After reading this agreement, if you accept the
terms, please Sign Up.
You may terminate this Agreement by giving us
written notice mailed to the attention of the
Scheduler.
You
will be an independent contractor of A Step
Above and nothing contained herein shall
create the relationship of employer and employee.
A Step Above will not withhold any income
or social security taxes from your compensation or
pay any social security or employment security
taxes with respect to you. You will not be an
agent of A Step Above. Your sole obligation
to A Step Above will be to perform the
assignments, which you accept, and to keep all
information gathered on your assignment
confidential as described below.
You
agree to provide A Step Above with
evaluation services on an assignment basis. The
evaluation services will involve observation and
evaluation of certain businesses and products in
accordance with our clients’ requirements for
the assignment, which we will communicate to you
prior to your acceptance of each assignment. A
Step Above specifications will relate directly
to the results expected and not to the details of
performance, which shall be in your sole
discretion. Within the bounds of the assignment,
you will control the time and manner of performing
the assignment.
A
Step Above will
quote to you the fee for a particular assignment
in advance of your acceptance of the assignment.
There will also be reimbursements for certain
purchases required in connection with the
assignment. You will be responsible for all other
expenses, which you incur in the performance of
services for A Step Above. All compensation
will be paid on or about the 30th of
each month, in most cases covering completed
assignments received in our office during the
previous month. A Step Above is not
required to offer you any minimum number of
assignments during any period of time.
A
Step Above
has no control over or involvement with the
products or services of its clients, which you may
purchase or utilize in the performance of an
assignment. If you suffer any damage, cost or loss
as a result of or in connection with the products
or services of A Step Above’s clients,
you will make no claim against A Step Above
for such damage, and you will hold A Step Above
harmless with regard to any claim you may assert
against any other party.
A
Step Above’s
clients have a legitimate interest in keeping the
assignments confidential as well as all
information gathered during an assignment.
Therefore, you agree not to disclose the names of A
Step Above clients, the location of the
assignments, or any information gathered during an
assignment to anyone other than representatives of
A Step Above. This agreement specifically
prohibits you from disclosing such confidential
information to A Step Above competitors,
but this agreement is not limited to competitors.
Furthermore, you may not use confidential
information and questionnaires for your own
benefit separate from completing assignments for A
Step Above.
The
laws of the State of Florida will govern this
Agreement. All instructions A Step Above
gives you regarding your assignments, whether oral
or written, are included in this Agreement by
reference, provided that any instructions, which
are inconsistent with the terms of this Agreement,
must be in writing to be effective.
We
expect you to complete accepted assignments in a
professional manner. Prompt, accurate reporting is
vital on every assignment. By following our
thorough and concise instructions you can provide
essential services to A Step Above and will
enjoy interesting, independent assignments, along
with supplemental income. We welcome you to A
Step Above team.
If
you accept an assignment from A Step Above,
you will be deemed to have agreed to the
Independent Contractor Agreement terms.
